Pursuant to the California Public Records Act (California Government Code section 6250, et seq.), I ask to review and/or obtain copies of the following, which I understand to be held by your agency: All records pertaining to:

1a. Any available information related to calls for service to the residence of District 11 Councilman Mike Bonin (3777 Boise Ave., Los Angeles, CA, 90066) on 4/4/2020 at 23:19, 4/4/2020 at 23:59, and 4/5/2020 at 0:39. This request includes but isn't limited to the type of call (i.e. 911 or non-emergency) and any call transcripts, the incident code, face sheet(s), report(s), any victim statement(s), any witness statement(s), any descriptions of any injuries sustained by any victim(s), any lists and descriptions of stolen property, and other non-confidential information.

1b. Any available information related to officer-initiated (Code 6) calls for service to the same address on 4/7/2020 at 13:25, 4/9/2020 at 13:34, 5/21/2020 at 20:54, and 5/24/2020 at 13:23. This request includes but isn't limited to the incident code, face sheet(s), report(s), any victim statement(s), any witness statement(s), any descriptions of any injuries sustained by any victim(s), any lists and descriptions of stolen property, and other non-confidential information.

2. Additionally, photographs and video show significant LAPD response to peaceful protests at Mr. Bonin's residence on 5/17/2020, 5/24/2020, 6/7/2020, and 6/14/2020. These calls do not appear on the spreadsheet provided in response to an earlier request (#20-3994). I request any and all available information related to these calls.

I make this request as a journalist. Disclosure of the requested information to me is in the public interest because it is likely to contribute to public understanding of city government.

I ask for a determination on this request within 10 days of your receipt of this request, and more promptly if you can make a determination without having to review the records in question.

If you determine that any or all of the records are exempt from disclosure, please note whether the exemption is discretionary, and if so why it is necessary to exercise your discretion to withhold the information.

If you determine that some but not all of the records are exempt from disclosure and you intend to withhold it, I ask that you redact the exempt portions and make the rest available.

On July 28, 2020 we responded to your request for any available information pertaining to particular calls for service to 3777 Boise Ave, Los Angeles, CA, 90066. The response should have been as follows:

 

Your request was made under the California Public Records Act (the Act). The Department is cognizant of its responsibilities under the Act. It recognizes the statutory scheme was enacted to maximize citizen access to the workings of government. The Act does not mandate disclosure of all documents within the government’s possession. Rather, by specific exemption and reference to other statutes, the Act recognizes that there are boundaries where the public’s right to access must be balanced against such weighty considerations as the right of privacy, a right of constitutional dimension under California Constitution, Article 1, Section 1. The law also exempts from disclosure records that are privileged or confidential or otherwise exempt under either express provisions of the Act or pursuant to applicable federal or state law, per California Government Code Sections 6254(b); 6254(c); 6254(f); 6254(k); and 6255.

 

With regards to your request #1a and #1b, in accordance with Section 6254(f) of the California Government Code, records of investigations conducted by, or investigatory files compiled by, any local police agency for law enforcement purposes, are exempt from disclosure. Should any records be located, 9-1-1 telephone calls, recordings, transcripts, witness statements, victim statements, face sheet(s), reports, and logs are either investigatory records themselves or properly part of an investigative file and therefore exempt from disclosure. The records may be produced in response to a subpoena or court order.

 

Our authority to provide information is dictated by Government Code Section 6250 et seq., otherwise known as the California Public Records Act.
