The Los Angeles Police Department (“LAPD” or “Department”) has received two requests from you pursuant to the California Public Records Act (“CPRA” or “Act”), which you submitted via Next Request. Specifically, your requests seek (i) records pertaining to “any and all private security details LAPD provided to Councilman Mike Bonin’s residence between June 22, 2017 and June 22, 2020”; and (ii) calls for service to that location (3777 Boise Ave., Los Angeles, CA, 90066) for the same time period.
The Department is cognizant of its responsibilities under the Act, which is codified in California Government Code Section 6250, et seq. It recognizes the statutory scheme was enacted to maximize citizen access to the workings of government. The Act does not mandate disclosure of all documents within the government’s possession. Rather, by specific exemption and reference to other statutes, the Act recognizes that there are boundaries where the public’s right to access must be balanced against such weighty considerations as the right of privacy, a right of constitutional dimension under California Constitution, Article 1, Section 1. The law also exempts from disclosure records that are privileged or confidential or otherwise exempt under either express provisions of the Act or pursuant to applicable federal or state law, per Government Code Sections 6254(b), 6254(c), 6254(f), 6254(k), and 6255. It is with these considerations in mind that the Department responds to your request.
The Department conducted an inquiry and search for responsive records in its possession, and did not identify any records pertaining to security details for Mr. Bonin. The Department also conducted an inquiry and search for Calls for Service made to the address specified in your request, and will provide you with the attached printout of LAPD patrol Calls for Service to that location for the time period requested, pursuant to Govt. Code § 6254(f)(2). The Department will also provide you with a three-page handout, which will assist you in interpreting the Calls for Service printout.
Please note that any crime or investigation reports/records associated with Calls for Service, to the extent any exist, are investigatory records and/or files that are exempt from disclosure under Govt. Code § 6254(f) and, as such, the Department declines to disclose them.
